Workers Compensation

The  workers’ compensation course is designed to aid the insurance adjuster in handing claims in W/C. Students are required to read their assignments and to answer examine questions in the form of an essay. Each student has his/ her own analysis and theories of settling claims and each adjuster will have different answers on their examines. The course is design to help the student to generate independent thought in analyzing liability. That independent thought is what insurance companies look for in promoting adjusters to senior level positions and management. An adjuster must know both sides of the fence when handling insurance claims. That is an insurance adjuster must know an attorney’s strengths and weakness when negotiating claims as well as realizing his/ her own strengths and weakness.

The best way to pass each examine is by the student backing their position by way of quoting case law, segments from their reading assignments, statues and providing mathematical equations.

Employment Related Actions: Remedies at Common Law, By State and Federal Statutes and Under the Act, Exclusiveness of Act as a Remedy, Employments Covered By the Act Exempt, Employment, Extraterritorial Application & Other Coverage, Accidents Arising Out Of & In the Course of Employment, Occupational Diseases, Defenses & Defense Related Matters, Third Party Actions, Medical Benefits, Disability & Death, Administration, Practice & Procedure, Federal Coverage, Forms and Statutes.

 

Sample Examination

EXAM III

Hank Johnson worked for a temp-service as a computer programmer.  The  Clinic requested a temporary worker to be sent to the Clinic to help out with the work over-load.

When Hank arrived at the Clinic, James Johnson, a full time employee, felt his job was threaten and punched Hank in the face breaking his jaw. Hank left the Clinic and went to his lawyer’s office about his jaw.

Hank left his lawyer’s office and on the way back to the temp- service to tell them that he quit, he was in involved in an auto accident and broke his left leg as a result of another driver running the red light.

Hank is now claiming workers’ compensation benefits for his jaw and left leg. James Johnson alleges that Hank hit him first and James in turn struck Hank back in self-defense.

Your claims manager provides you with the above facts and request that you provide a report and analysis of liability exposure on the part of workers comp. negligence, and any possible defense.

You are to write a report to your supervisors outlining ALL possible defenses from your reading assignment. Please provide case law and statues to support any defense strategies. [A page and a half would be adequate].
