How to avoid exposure to an E&O claim against your profession?

1. Be consistent in your paper work 

a. If it can be shown that you sometimes  write down what you tell your clients and sometimes you do not, then your client's version of what was said to him/her is more believable since you now show a pattern of deviating from your standard course of practice.    

2. Know your product 

a. If you are selling a product or service make sure you understand the product and service and what you provide meets that client's needs. More often the buyer will look to the seller if the product is defective or is not what it purports to be or you failed to properly warn of the danger of the product or the use of services.( see product liability )

3. Know what your policy says 

a. make sure you have proper E& O coverage. Also make sure your policy does not exclude fines and penalties. If your policy does exclude fines and penalties, you may be paying out of your own pocket. You may want to keep searching for a better policy.
