Workers’
Compensation Laws are similar in concept to that of liability without regard
to fault. However, workers' compensation applies
only to workplace injuries.
All fifty states have developed comprehensive workers’ compensation
statutes, although some states have allowed employees the option as to
whether they want to be covered by the
statute or whether they do not want the coverage.
The basic
concept behind Workers’ Comp is that the statute eliminates an employee’s
right to sue the employer for a
work-related injury. However, it does imposes automatic liability for
compensation upon the employer.
Workers’ Comp
has replaced the rights of recovery as it is normally conceived under common
law. Workers’ Comp. has
created a system in which injured employees receive definite compensation
according to scheduled and non-scheduled injuries.
If the injury
is work-related, the employer must pay, regardless of who is at fault,
however, there are
exception that vary from State to State.
